Michael Jackson killed himself says defense for doctor facing manslaughter rap

LOS ANGELES- The defense for the doctor facing trial for involuntary manslaughter inMichael Jackson's death will suggest the singer actually killed himself, a prosecutor said during a hearing Wednesday.

"I do think it's clear the defense is operating under the theory that the victim, Michael Jackson, killed himself,"saidDeputy District Attorney David Walgren.

"They don't want to say it but that's the direction in which they are going."

The statement came at a hearing where a lawyer forDr. Conrad Murrayclashed with the prosecutor over who should test residue from two syringes found in Jackson's bedroom.

Defense attorneyJ. Michael Flanagandeclined to comment on any theories of defense outside court and said lawyers were still investigating the case.

A preliminary hearing is scheduled to begin Jan. 4 after whichSuperior Court Judge Michael Pastorwill decide if there is sufficient evidence to hold Murray for trial. The issue of residue in the syringes is unlikely to be brought up in that hearing, attorneys said.

Jackson died on June 25, 2009, of what was later found to be acute Propofol intoxication, with other sedatives found to have been a contributing factor.

But Flanagan told Superior Court Judge Michael Pastor that a huge amount of the anesthetic Propofol - possibly 150 milligrams - would have had to be present in Jackson's body to reach the level that killed him. He noted that Dr. Murray has said he gave him only 25 milligrams of the drug along with small amounts of benzodiazopines - sedative drugs - to help him sleep.

There have been suggestions that during a brief period when Murray left the room Jackson, possibly desperate for sleep, could have injected himself with more of the Propofol.

Flanagan said a broken syringe was found on the bedroom floor in addition to a syringe in an intravenous medication bag. He said a fingerprint found on the broken syringe hasn't been identified.

Kanye West's fashion stylist: Meet Clay Cassius, a 19-year-old Yale student

The person responsible forKanye West's fashion style may surprise you.

MeetCassius Clay, a 19-year-oldYale Universitystudent who, with a combination of luck and skill, has become the creative consultant and personal stylist for one of the biggest music stars in pop culture today.

In what's being touted as his"first-ever interview", Clay recounted to retail companyOpening Ceremonythe fateful day that West complimented his style while shopping at Barney's. The two went on to exchange e-mail addresses, and the rest, as they say, is history.

Clay, an art history major at Yale, took the fall semester off to work for West, a controversial figure for his often outlandish statements but a highly regarded celebrity for his fashion sense.

Amazingly, Clay's parents didn't disapprove.

"My father is in his 80s and my mother in her 60s so they're not exactly Kanye's typical listening demographic,"he explained to Opening Ceremony."Still, they could appreciate opportunity and were very supportive of a productive pause in my track at Yale."

And now West can count the young man's parents as fans.

"My mother made aTwitteraccount to follow Kanye (not me),"Clay revealed,"and I've found both {Wests' albums} 'Graduation' and 'My Beautiful Dark Twisted Fantasy' in my father's car."

Clay also gave his insight, no doubt already shared with West, on how to obtain the"perfect look."

"An external reflection of personality that admits both reality and imagination,"he said."I haven't decided whether enthusiastic matching or dramatic juxtaposition is more contrived - or if that self-awareness is necessarily a bad thing - but both are to be respected for the thought that goes into them. Comfort is indulgent and ultimately forgettable."

And Kanye West is one person who is never, ever forgettable.

Apparently neither is Yale - according to the interview, Clay is currently preparing to return to school. No word yet on how this will affect his gig with the megastar.

All the single ladies! Jennifer Aniston, Courteney Cox spend Christmas Eve together

Jennifer AnistonandCourteney Coxapparently took the"Friends"theme song to heart.

In the spirit ofThe Rembrandts,"I'll Be There For You,"Aniston spentChristmas Evewith her best friend and former co-star, who is still in the midst of a separation fromDavid Arquette.

The two pals, who became BFFs while working on the hitNBCseries, took comfort in each other during a holiday usually celebrated with relatives.

"Jen and Courteney are tired after a long year,"a source told People.com."They celebrated Christmas {with} each other and just focused on making things special for Coco,"Cox's six-year-old daughter with Arquette.

Both Aniston, 41, and Cox, 46, spent much of 2010 unlucky in love. Aniston was linked in the gossip magazines to a number of men, fromGerard ButlertoJason Sudeikis, but no guy proved a match for the movie star. Cox and Arquette split shortly after their 11th anniversary in June, though it didn't become public until the fall.

Cox toldAustralia's TV Week in early November that she's been relying on Aniston as she copes with the fall-out of her separation.

"We just have fun, we laugh, we're inseparable and it's great,"Cox explained."It's funny, a lot of really close friends are kind of going through this right now or like Jennifer {who} has gone through it {with ex-husband,Brad Pitt}. I don't know what's going on in the planets or what, but things are being shaken up and I don't know what's going to happen, but, yeah, Jennifer has been amazing for sure."

The"Cougar Town"star also revealed to the publication that while she didn't"know what will happen"with Arquette, it was"not like we're getting divorced"- a statement that the People sources still say is true.

In fact, Arquette, 39, did spend some time with Cox and their daughter during the holiday, although sources told the site that the"Scream"actor is still struggling with the split.

Perhaps he could use a 'Friend' of his own.

Oscar buzz-worthy: Leonardo DiCaprio headlocks Jesse Eisenberg at a bar for fun

Red-carpet rivalry got physical for potential best-actor Oscar nominees Leonardo DiCaprio and Jesse Eisenberg. Last weekend the pair hit Snap on 14th with a group of pals for a dudes' night out. While watching ultimate fighting on TV, Leo took the opportunity to demonstrate his skills, a source tells us, jumping on Eisenberg's back and locking his head in a"guillotine"hold - much to the amusement of fellow bargoers.

Brittny Gastineau likes birthdays

Sounds like Brittny Gastineau has birthdays on the brain in more ways than one. A source tells us the former reality star, linked in the past few weeks to Olympian Michael Phelps, was spotted on Friday at a Duane Reade at 63rd and First buying a pregnancy test and a birthday card.

That same evening, the dark-haired beauty drank only Diet Coke while celebrating agent Darren Bettencourt's birthday at the Gansevoort Park Hotel's Asellina restaurant, where she seemed quite smitten with foursquare founder Dennis Crowley. A close pal of the 28-year-old confided that Brittny is in New York promoting her Tres Glam jewelry line and"barely has time for a boyfriend, let alone for a baby."A spokesman for Gastineau tells us he doesn't comment on her personal life.

Paterson doesn't want to reverse with Rangel spot

Gov. Paterson was among those who turned up at Elaine's on Friday night to mourn the passing of namesake restaurateur Elaine Kaufman. And since Elaine's saloon was always a place where news was made and discussed, we didn't think she'd mind us asking the governor for his reaction to our report Friday that his name has surfaced as a replacement for recently censured Rep. Charles Rangel - that is, of course, if Rangel, who was resoundingly reelected in November, decides to give up his seat.

As Paterson departed Elaine's he told us he wasn't interested in the job, even after we cajoled him a bit by telling him how"great"he'd be.

"I'd be great for it,"the governor replied."And I'd be going backwards."

Juicy journalism emerges with Vice

The aging hipster: A figure of scorn no more. Vice Magazine co-founder Shane Smith tells Gatecrasher that when MTV was testing out his new show,"The Vice Guide to Everything,"he saw a focus group survey that asked viewers questions like,"Is the host too old? Does the host's age bother you?"Evidently, it did not: 40-year-old Smith got to remain the graybearded face of"globetrotting gonzo journalism."

The show doesn't premiere until Monday, but Vice screened the first two episodes last Wednesday at the Landmark Sunshine Cinema. Afterward, Smith was gregarious, accepting congratulations from a crowd of rum-drinking revelers that included buddies like director Spike Jonze.

Eckhart won't fall for Kidman's set-up

Nicole Kidman: Matchmaker? Aaron Eckhart thinks not. At the"Rabbit Hole"premiere on Thursday at the Paris Theater, we asked Eckhart if he'd ever let his co-star, who has said he'd make"a really good husband,"set him up on a date."No!"the noticeably flustered star laughed."This is so embarrassing. Um, it's sweet of her to say."

But the 42-year-old could have used Kidmans's help at the after-party held at The Plaza hotel's Oak Room: While a source tells us the alabaster beauty left the fete after a brief appearance because she was feeling under the weather, Eckhart stayed an hour and a half longer, but avoided chatting with the swarm of pretty ladies circling him.

Tennis pro calls Elton John 'crafty'

Goodbye Yellow Brick Road, hello tennis court. At the Sports Illustrated Sportsman of the Year Awards (which honored the Saints' Drew Brees), Billie Jean King told us that her old pal Elton John is a force to be reckoned with when he gets his hands on a racket."He has a great forehand. I don't think a lot of people realize that he plays on tour every morning,"the former tennis pro said."I don't play with him anymore because he doesn't like to hit it back and forth with me. He always wants to hit it away from you and he wants to challenge you. He's very crafty and mean."And she said, she tells him so.
